Other game's artwork as base

I have a good number of texture images taken from games called Spec Ops and Severance: Blade of Darkeness available to enlarge the current textures files for Korax projects. I would like to know if the use of such images are acceptable, since I believe at least the last one is still a comercial game (even though the original company doesn't exist anymore). A couple of things should be clear: All images used are heavily moddified from it's orginal version (not exactly to make it difficult to be associated with the original game, but actually because Hexen is an old game and demand specific sizes and general style in graphics that are non existant in recent games. A ground skin for example when resized to 64x64 will be absolutely different fron it's original appearance, beyond recognition in fact. The later work of converting the colors from one palette to the other also make it look even less like the original file. Also, the main work of transition from a game to Hexen focus only in general like textures, going from dirt, grass, mud, rock, or construction materials. Never any kind of specific image associated somehow with the game's stroyline or gameplay is going to make it (like sulptures carved on walls, symbols, entrances, specific architecture decorations, etc.). I'm asking this because I've been trying my hand on converting those images and transform them in decent patchs and flats for the various kind of maps that will need to be done, specially in SE and TSP, and I must say this is an important resource for this kind of images, in which I'm a total zero. And to be franc, I don't think there's much wrong in using original work as a base for the creation of heavily moddified versions (even though I totally disagree in using openly images taken from others games, or slightly different (changed colors, etc.)). What do you guys think?

On a serious side, I don't think anyone would be able to sue a non-profit project? For what I read in other people's MOD sites (like the AvP sites, where they use properties of BIG movie companies), the worse it gets is that they recieve a e-mail demanding them to take away any original data from their projects. Of course any comercial use if the brand Aliens or Predator, in this example, would be immediatly shut down by Fox, etc. I think it's absolutely right to protect one's copyrighted material, but if the gaming companies would be really strict, all interest from the community wold dye quickly, because the one thing that keep them moving (MODs and TCs) is by definition a reuse of orginal and compyrighted material, just for non-hamrful purpouses. Even a complete Total Convertion will have to use at least the original game's engine, sound structure, graphic cpaacities etc...

That's why I hope that by the time we're finished with TCS we might get away with using modified DK maps.
